These Terms of Service, together with the policies referenced in them, describe the terms that apply when you visit our website or purchase from us.
By visiting, interacting with or purchasing through our website, you agree to these Terms of Service and our Privacy Policy. Nothing in these Terms limits any mandatory rights you have under applicable consumer law.

2. PRODUCTS
We make every reasonable effort to represent our artwork, prints and other products accurately. Colors and appearance may vary slightly depending on your screen, device and display settings.
Because many of our products are artist-made, hand-finished, signed or produced in small editions, minor variations may occur.
Product descriptions, availability and prices may be updated from time to time. We may discontinue a product or limit quantities where reasonably necessary.
3. ORDERS
Placing an order constitutes an offer to purchase the products in your order. An order is accepted when we confirm acceptance of the order.
Please check your order information carefully before submitting it.
If we are unable to fulfill an order, we will contact you using the information provided with your order and refund any applicable payment.
Your statutory consumer rights remain unaffected.
4. PRICES AND PAYMENT
Prices are displayed in the currency shown on the website and include VAT where applicable unless otherwise indicated.
Any applicable shipping charges will be shown before you complete your purchase.
For deliveries outside the European Union, the recipient may be responsible for customs duties, import taxes or other charges imposed by the destination country unless otherwise stated at checkout.
Payment must be successfully processed before an order can be fulfilled.
5. SHIPPING AND DELIVERY
Available shipping destinations, shipping charges and estimated delivery information are provided on our website or during checkout.
Delivery times are estimates and may be affected by postal carriers, customs processing and circumstances outside our reasonable control.
For sales to consumers where applicable law requires it, Shawna Koontz Studio bears the risk of loss or damage during transport until the goods have been received by you or by a third party designated by you, other than the carrier.

6. RETURNS AND RIGHT OF WITHDRAWAL
Consumers may have a statutory right to withdraw from an online purchase within 14 days without giving a reason, subject to the exceptions provided by applicable law.
Details about returns, withdrawal rights, applicable exceptions, return shipping and refunds are provided in our Refund Policy.
Nothing in our Refund Policy or these Terms limits statutory consumer rights.
7. SUBSCRIPTIONS AND MAIL CLUB
Some products, including the Art By Mail Club, may be offered as recurring subscriptions or prepaid subscriptions.
The price, billing frequency, duration and renewal terms applicable to a subscription are displayed before purchase.
Recurring subscriptions continue according to the billing schedule selected at purchase until cancelled.
Customers may cancel recurring subscriptions using the cancellation options made available through our website or customer account, or by contacting us at hello@shawnakoontz.com. Cancellation applies to future renewal charges and does not ordinarily reverse an order that has already been processed or fulfilled, except where required by applicable law.
Prepaid subscriptions cover the stated prepaid period and do not automatically renew unless this is expressly stated when purchased.
Additional cancellation or withdrawal rights required by applicable consumer law remain unaffected.
8. LIMITED EDITIONS AND ORIGINAL ARTWORK
Where a product is described as a limited edition, the edition size and other edition information will be stated in the relevant product description.
For Faraway Fine Art Mail Club editions, edition sizes may be determined by the number of eligible members for that edition. Once an edition is closed, it will not be reprinted as the same limited edition.
Original artwork is unique unless otherwise stated.
Purchase of an original artwork, print or other product does not transfer copyright or reproduction rights in the artwork.
9. INTELLECTUAL PROPERTY
Unless otherwise stated, artwork, photographs, illustrations, text, graphics, videos, designs and other original content displayed through this website are owned by or licensed to Shawna Koontz Studio and are protected by applicable intellectual property laws.
Purchasing artwork or another product gives you ownership of the physical product but does not transfer copyright or other intellectual property rights.
Content from this website may not be reproduced, distributed, commercially exploited or used to create derivative works without prior written permission, except where permitted by law.
10. THIRD-PARTY SERVICES
Our website may use or provide access to services operated by third parties, including payment processors, shipping providers and Shopify.
Your use of those services may also be subject to the applicable third party's terms and privacy policies.
Shawna Koontz Studio is powered by Shopify, which provides the ecommerce infrastructure used to operate this store. Purchases made from our store are transactions between you and Shawna Koontz Studio.
11. PRIVACY
Personal information collected through this website is handled in accordance with our Privacy Policy and applicable data-protection law.
Because our store is hosted by Shopify, certain personal information is processed by Shopify and other service providers as necessary to operate the store, process orders and provide the services you request.

Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, availability, shipping charges or other information.

The version applicable to a purchase is generally the version in effect when that purchase is made, except where applicable law permits or requires otherwise.
For ongoing subscriptions, material changes will be communicated as required by applicable law. Where required, customers will have the opportunity to cancel following such changes.
16. GOVERNING LAW
These Terms and contracts entered into through this website are governed by the laws of the Netherlands.
If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under the laws of your country of residence.
